Terms & Conditions

1. Contractual Relationship and Acceptance

These Terms and Conditions ("Agreement") govern the legal relationship between Kyoto Bunny Tours ("the Company", me, Richard Flass) and any individual booking or participating in a tour ("the Customer", "the Participant", "you"). By completing a booking, submitting payment, or participating in a tour, you acknowledge that you have read, understood, and unequivocally agreed to be bound by all provisions of this Agreement.

2. Booking, Payment, and Formation of Contract

2.1.Contracts are only formed with individuals aged 18 and over. Minors must always be accompanied by an adult. The booking is confirmed upon full payment through my offical system and issuance of a written confirmation.
2.2. The Company reserves the right to refuse service or cancel a booking at my sole discretion prior to the tour start time.

3. Cancellation and Refund Policy

This section defines the financial terms of cancellation. All cancellation requests must be submitted in writing via email to info@kyotobunnytours.com.

  • 3.1. Standard Cancellation: Customers may cancel their booking with a full (100%) refund of the tour price if the written request is received at least 24 hours prior to the scheduled tour start time.

  • 3.2. Late Cancellations and No-Shows: Cancellations made less than 24 hours before the scheduled tour start time are strictly non-refundable. This policy applies regardless of the reason for cancellation, including but not limited to travel delays, illness, or personal emergencies.

  • 3.3. Punctuality and Late Arrivals: Tours commence strictly at the scheduled time. Participants who arrive late are responsible for locating and joining the group at their own effort and expense. If a Participant is unable to join the tour due to lateness, it will be treated as a "no-show," and no refund, partial credit, or rescheduling will be granted.

  • 3.4. Cancellation by the Company: I reserve the right to cancel any tour due to severe weather warnings (e.g., Typhoons), safety concerns, or unforeseen operational circumstances. In such events, the Customer will be offered a full refund or an alternative date. Kyoto Bunny Tours shall not be liable for any ancillary costs (e.g., airfare, hotel bookings) incurred by the Customer.

4. Liability and Safety Disclaimer (Assumption of Risk)

  • 4.1. Urban and Historic Environment: The Participant acknowledges that cultural walking tours take place in public spaces, including historic districts which may feature uneven stone paths, steep stairs, narrow walkways, and high pedestrian or vehicular traffic.

  • 4.2. Assumption of Risk: By participating, the Participant voluntarily assumes all inherent risks associated with walking tours. Participation is entirely at the Participant's own risk and responsibility.

  • 4.3. Limitation of Liability: To the maximum extent permitted by Japanese law, Kyoto Bunny Tours, its tour operator, and employees shall not be held liable for:

    1. Any personal injury, illness, or death occurring during or as a result of the tour.

    2. Any loss, theft, or damage to personal belongings (including cameras, electronics, or luggage).

    3. Any delays or disruptions caused by public transport, third-party vendors, or external environmental factors.

  • 4.4. Health and Physical Condition: The Participant warrants that they possess the physical health and fitness required for a walking tour of the stated duration. The Company is not responsible for any health complications arising from the physical exertion of the tour.

5. Participant Conduct and Authority of the Guide

Participants must comply with all safety instructions provided by the guide and show respect to local residents, religious sites, and other guests. I reserve the right to immediately exclude any Participant from a tour—without refund—if their behavior is deemed inappropriate, disrespectful to the local culture, or poses a risk to themselves or others.

6. Itinerary Modifications

The route, content, and duration of the tour may be adjusted without prior notice to account for weather conditions, temple/shrine closures, excessive crowds, or local events. Such modifications do not constitute a breach of contract and do not entitle the Participant to a refund.

7. Personal Data and Privacy

The collection and use of personal data (including name, email address, and phone number) are governed by my Privacy Policy. Data is collected solely for the purpose of booking management and communication. I do not store payment information.

8. Personal Insurance

Kyoto Bunny Tours does not provide insurance for Participants. We strongly recommend that all Participants obtain comprehensive travel and health insurance that covers walking tours, personal accidents, and trip cancellations.

9. Governing Law and Jurisdiction

This Agreement and all disputes arising from it shall be governed exclusively by the laws of Japan. The parties agree that the courts of Kyoto, Japan, shall have exclusive jurisdiction over any legal proceedings.
